About 4 months ago I was in an auto accident. As I was driving around a bend (headed West) a car headed on opposite direction slammed into my car right behind my driver side door. He also took the rear tire and axle off the car. It is completely totalled. His car has minor damage to front left corner. My car is worth $6k and also have $2k in medical bills for my injuries. Unfortunately did not have collision or medical coverage. He told his insurance company that I was driving in his lane. But if that were true it wouldve been a front end collision, right? Anyways his insurance denied my claim. When I contacted a lawyer a secretary yelled at me cause I didnt call the police and said they couldnt help me. Just didnt think they would come out since it was a rural town with unpaved roads. Anyways would you sue him in small claims court? Max limit is $7500. Do you think I have a winable case? I am also worried he may countersue. Or should I just leave it alone in case I lose? I do have plenty of photographs that show he hit me and that he failed to make the sharp turn but instead veered into my lane. Didnt call the police cause he said we shouldnt call. Plus in the past I know people who called and cops refused to show up. The width of the road is just 20ft so he had to turn sharply but i feel didnt because even in photos his car is perpendicular even tho road turns sharply.
