OK soo my boyfriend got pulled over because his exhaust was too loud. the officer asked if he could search the car and my boyfriend said no, because 1. His cuz. (who is an officer) had always told him that it wasn't required to say yes, but it was kinda frowned on if u didnt 2. we were in a hurry BUT NOT SPEEDING to make it to my girlfriends house to take my friend to the hospital bc her boyfriend couldn't because he was at work (allergic reaction she looked like Will Smith in the movie Hutch or w.e its called lol no joke...) ANYWAYS he kept insisting that we COULD NOT say no, but we kept telling him no we didnt consent, until finally, my boyfriend was just like whatever ur not gonna find anything and this is a waste but we are in a hurry so whatever. so he made us BOTH get out of the car, and i had my purse around my shoulder/neck. the officer asked if he could search my purse. I said no, because im sorry, but a girls purse is personal in my opinion, and i dont want a stranger digging threw all of my stuff. He said he needed to to make sure i didn't have any weapons (mind u we were driving in a small city in wisconsin where its all richy rich people *google Mequon, Wisconsin and you will under stand* and the crime rate is below like 20% its not like anyone would be carrying a weapon or bomb in their Marc Jacobs purse lol) i told him that he could NOT search my purse, but he was more than welcome to pat the outsides of the purse and feel on the OUTSIDE of my purse for weapons, because i understood it was his job, and he has the right to make sure he is safe while doing his job. He said that i wasnt allowed to say no, but i kept saying no officer i understand your just doing you're just doing your job, but i do NOT give consent for u to search my purse, and my boyfriend and i do not consent to ANY searches of ANY kind. well my this time the officer was threatening me and yanking on my purse (so hard i ended up having bruises around my neck from him pulling on it) and then he started to take out his hand cuffs and threatened to arrest me... well by this time i second guessed myself and thought that if i was wrong, and he was right, that i couldnt afford a ticket and i was scared because the mequon cops once arrested a kid, put a bag over his head bc he was out of control and screaming and spit out blood or w.e bc he got hurt while being arrested or sumthing and it killed him (because they used the WRONG type of bag n not the breathable one, and the kid ended up suffocating to death and the cops walked away without even getting a minor slap on the wrist pretty much!) n i was worried about my friend so i was like fine go threw it but i dont have anything so your just gonna feel stupid for hurting me and making this such a big deal sir. (by this time i was sick of getting hurt n treated with sooo much disrespect when i was being respectful while i was exercising what i THOUGHT was my right...) he ran the dog around the car and the dog only went and sniffed where the guy pointed and he didnt bark at all (which, he is trained to do, because back in the day like 4 years ago, my boyfriend had a 2-3 month phase where he thought it was cool to smoke, and he got in trouble with his friend, and lol it scared him into never doing it again bc the dog literally tore up the car and broke the window that was rolled half way down when it jumped in) but yeah the dog never hit on the car, and when we pointed that out the officer asked us if we were trained K9 unit ppl and we said no, and he is like well i am and I said he hit on the car, but instead of letting the dog go threw the car like he did this time, he took the dog back to his car and came back and searched the car himself. It took FOREVER, and we NEVER got patted down or anything lol, and the cop kept saying how we were liars and that his dog has NEVER been wrong in the 5+years he has been working with him. well, after like 30-40mins or more and after me telling the OTHER cop about my friend and him not caring at all, and after talking about how i was in college to become a lawyer, and specialize in Criminal defense or maybe something with people's rights being ignored(i dont member how i exactly said it lol but it sounded better at the time lol BTW it is not actually my major, but it IS one of my choices) the cop got out of the car, gave us this look like he was going to literally kill us, he said ok, get back in your car, and im giving you a 15 day to fix your exhaust. We asked him if he had found anything in the car and he said no, then i asked him if he had found any WMDs or any weapons in my purse, and he said no lol then we told him to have a great night and we left. So i guess my questions R: 1. what rights do a *passenger* have 2.what are my rights in regards to my zipped-shut purse 3.Could we get arrested for not consenting2aSearch 4.whatRmy rights as a driver5Is there a way to end a trafficStop if its been going on4a While? 6.Can u s 1. we were VERY polite to the officer i just want to make that EXTREMELY CLEAR to everyone. I respect officers, and i know their jobs require them to be paranoid and untrusting. 2. his exhaust was loud because a piece of it had broken off like 2 days earlier, and he works from 7am- 10:30ish PM mondays-fridays and saturday's he works from 8am-6pm he has two jobs that dont pay more than min. wage because he got laid off due to the economy... we just BARELY make our bills now, so we REALLY couldnt afford to take off to get it fixed/ pay the $300 to get it fixed. and his car is stick shift which idk how to use AT ALL (and he uses it to get from place to place for his job) otherwise we would have swapped cars. and Im sorry that we arent rich, and couldnt afford to get a brand new silent car or afford to get it fixed right away after it broke, but seriously, we are law abiding citizens and havent had a record since we were young... Wow just think if you would have let him search the car that had nothing to hide, you all would have gotten to where you were going a lot faster. You were being belligerent and that's a no no. But I'll tell you what did happen. Now your on the list, they keep a nice little file of you and your boyfriend. You think you got harassed this time, wait till next time. They are going to have their guns out, and they are going to MAKE you get on the ground and spread eagle baby! Sure you can try and sue, but can you prove any of it. Police don't care if you say no, as you can see it didn't mean a damn thing did it.. He got to search you anyway.
