So at the beginning of July, I was on my way home from the drive-in in Winchester, so it's about 2 a.m on a Saturday morning. I was tired, and driving my parents much newer (and more responsive) car. A car was following me for a quite a while, and I kept gradually speeding up. The touch was so light on this car compared to my normal car, that before I knew it, I was being pulled over. 83 in a 55. Yes, I know this is bad. I was very respectful and polite to the cops, showed understanding, and he "let me off" with a Failure to Obey a highway sign. I plan on going to court so I can try to avoid paying (after not having tickets for nearly 2 years of driving, I get 2 within a month of each other). My question is: What possible defense can I use/what can I say so that they may drop the ticket down. I really can't afford the $90 they want me to pay for this, or the certain rise in insurance. There is no defence for going 28 over the speed limit. The excuse about driviong a different (more responsive) car is a looser, but it will give others in the courtroom a chuckle. If Virginia offers a "Traffic Violators School", and you have not used it on your other citation ask for the school. The ticket will de dismissed upon submitting the Certificate of Completeion to the court. You MUST ask for the school BEFORE paying the ticket, or pleading guilty.
