Can a Paraphernalia arrest stop me from pursing a Nursing degree?

on feb. 15 i got pulled over in midvale, utah for going 14 over the speed limit. the cop smelt the car and asked if i'd been smokin i said no. which was true i did however smoke earlier in my garage so i guess it stunk my car up. plus the pipe was under my seat so that probably made it smell too. I've been going to community college since '08 and getting all my pre-reqs for the Nursing program at the U of U or even just going thru the Salt lake community college nursing program. i have 1 or 2 more semesters before i can sign up for the waiting list to get into the nursing program. they said its about 2yrs minimum to get accepted. in some cases faster if u have experience already. but now i have a pre trial tomorrow and i have hired a lawyer who deals w/ paraphernalia. there wasnt any weed in the car just the pipe, they also took an altoid tin can that had some ash in it, and a 1inch jar that did have weed in it in one point. so all i was ticketed for was paraphernalia and speeding. I have done some research and read that Nursing boards check your arrest record. and dont often check if it has been expunged or dismissed. so what should i do? plead not guilty or plea of abeyance? I havent smoked since then and i'm also worried that my financial aid. i know if they find out about drugs then their is a consequence but im not sure what? I just wanna tell the judge that if this goes on my arrest record than my career is basically over in that i have wasted a couple of yrs and used up loans from financial aid. and i dont even have a job so it'll put me back even further. please no replies saying. u shouldnt have done it in the 1st place or somethin like that. i know what i've done is wrong and know this can make or break my life. if it helps this is my first time being convicted of anything ever. also i wasnt "arrested" like handcuffed or detained in a jail or anything. he just had me sit on the curb while he searched the car. he then said i had to be picked up even though i wasnt under the influence, i wasnt charged with a DUI. wasnt drug tested either. so does that mean its not on my arrest record? he just gave me a ticket and let me go. and if i can make it so i get it dismissed or something will this make my chances better?

This could in fact effect your nursing degree program. Since you have hired an attorney he can instruct you better on how to handle this matter and maybe even get it expunged.

First of all- the courts don't care whether or not it will affect your career or it will mean that you would have wasted time, so don't bother arguing that. Is smoking in your state/proving legal? Just try to be cooperative. You smoked close enough to driving that the smoke smell was still on you? If they find that out, then you can be charged with a DUI. Just accept to the paraphernalia charge and just say that you hadn't used it in a long time. Go to a rehab centre before your trial, and use this as defense to say that you have been clean and learned your lesson. Be the most angelic person possible, but don't deny, because it will only reveal worse offenses. There is a big possibility that you won't be accepted, because as a nurse you will have access to illegal substances so there's a threat that you could deal them. But also, you probably will not get financial aid or bursary from the school, because if you're buying pot, then you clearly have money. Sorry to be frank, but it's all true. Just be good and prove yourself and then hope for the best.

I am 13. My parents are divorced and are now fighting for custody. since they are no longer living together and i live with my mom right now because i hate my dad's behavior. (fyi... he is a manipulative, controlling, and emotionally abusive father) any ways since my mom has to work my grandparents are mostly raising me and my 3 siblins. my g-ma & g-pa are also very controlling. and i am going to have to talk to someone like a thearopist or lawyer or something and tell them stuff like why i don't want to live with my dad or something like that but my g-pa is trying to prep me up. all it is doing is stressing me out. But he is the kind of g-pa that if you disagree or tell him that if he is doing something that you don't like he will completely freak and totally leave you alone and not help you at all...but i still need his help and i don't want to hurt his feelings. and it is bringing back memories like that time that my older sister stole my mom's car and ran away with her boyfriend ( at the time she was 14) and she had to go to court and my dad was all up on her back and telling her what to say so that she didn't go to jail but then we moved to Utah and she did it again except last time she ran away with her girl friend. and she actually went to court cuz we still live in UT. any way... i don't know what to do... cuz there is also this boy at Midvale Mi...um my school who i have a crush on but he puts a sun in my sky just seeing him but that doesn't stop life from happening. the only place i can really get away from the world is the temple but i can't go there often. so how do i deal with my situation?

13 is a tough age. You are experiencing life at it's worst. If you can get through these next few years you can make it thru anything. You are a child and shouldn't be worrying about the grown up stuff. Get into your own activities. Find something to join so that it gets you out of the house more. Don't worry about your sister and what she did. If anyone brings it up, tell them you are not your sister, then add "but I could be if you keep on telling me that." That should shut up anything about comparing you with your sister. It is hard to be a teen because you don't have any control. So just be a kid and let the grown ups drive and see what happens. It all depends on if you end up with a conviction. I'm not sure about how your school would handle it and if asking a question about a conviction is even on the nursing school app. But, every hospital I'm aware of asks if you've been convicted of a felony or misdemeanor, and if you answer "yes", they give you a space on the application to briefly state what and when it was. Also, keep in mind, that if you do get a conviction on this, you must answer the application questions truthfully, because they will do a criminal background check on you when you apply for a position involving any type of patient contact/patient care in a hospital. Unfortunately, you're just going to have to wait until tomorrow to see where your case might be going, but let it be a "wake-up" call to you to make your decision on what is more important in your life: smoking pot or becoming an RN. Your attorney will advise you on how to present your "decision" to the judge if you are given an opportunity. Best wishes!

Answer:
A drug conviction (not arrest or ticket) can effect your eligibility for a nursing license. It varies from state-to-state but it's a pretty serious deal in the health professions. Even if you are licensed - that conviction will negatively impact your ability to gain employment. It's not a pretty situation you find yourself in. A drug conviction will also have serious effects on your financial aid. The result is that you're not eligible for federal financial aid unless/until you complete a drug treatment program. Those laws are for possession or sale though - I believe a paraphernalia conviction is equal to a possession. You'll need to discuss this with your lawyer and the financial aid office. Trust your attorney to look out for you best interests in the best possible way. Make sure he's aware that you're in college, receive financial aid, and are planning a nursing career. Let your attorney decide what it is you tell the judge.

Answer:
The big question isn't whether you can get a nursing degree, but whether you can get a nursing job. You need to check with the HR departments at your local hospitals to see if having a drug conviction on your record would affect your ability to be hired. Nurses work with narcotics every day, so most employers would automatically screen out anybody with any sort of illegal drug convictions on their records. I work at a health sciences school, and we run background checks on all of our students. If any of our students come back with hits on their background check - drugs especially - we run the scenario past the legal departments at the local hospitals. If they are unemployable by the hospitals, we won't admit them to our school either, just to keep them from taking out loans and wasting the two years of their lives.
