Caught shoplifting....charges?
Question:
Me and my friend got caught shoplifting in the Warwick Mall in Rhode Island at Macy's almost a month ago. The private investigator grabbed my friend and i after we had walked out of the store (we were outside heading to our car). She immediately grabbed our purses and told us to go inside after she had explained that she was a PI. I am 16 and my friend is 17 (both underage) and we have not yet recieved any notice in the mail describing our charges, court order, etc. Are they allowed to catch us after we had already walked out of the store with the merchandise?? It has been a while so i dont even know if we are going to be charged with anything but what is the law in RI for first offense underage shoplifting?? THANKS!

Answer:
As long as you are still on the property, including the parking lot, you can be detained. Many stores have a policy requiring you to leave before they can detain you. If they did not contact the police, they will be sending you something called a civil demand. They can sue you for three times the amount of the items you stole, plus reasonable court costs. Waiting a month is not unusual, this all has to go through their legal office.

Private impound took my belongings out of my car, wont give them back?
Question:
My car had been impounded a few months back, i've been trying to work with the guy to get my stuff out of the car, because i was goig to sign it over to the place where it was being financed from. Thursday i go, i had to pay 440 just to get my things, and upoin taking the stuff out, i notice ALL my paintball gear is missing. I asked the guy, and he said the Warwick Police siezed it, and that they would call them for me, and would get it back. after going back and forth a few times about why and how and for what reason, i decided ok, ill see what this guy can do. I called back later as he instructed me to do, and told me he had spoken to someone and they would get back to him tomorrow. i also called the police to ask about the matter and left a messege with the manager of the property room. called saturday and got no answer on either end, except that the property room guy would not be in until sunday. I called the Police today and they were unsure of what i was talking about, so i called the tow place. The guy then informs me, that hjis brother took the stuff, and that it was at his apartment ina room they used for storage for any things of value found in any cars. That either monday or tuesday they would have my stuff. My friend called, claiming she was my girlfriend, and tried to talk to him, and he told her, "the cars been here so long, we have every right to go in it and take stuff, and that we dont have to give her anything back. She then called and asked the police what to do, they told me to do down to the station tomo, and i could talk to an officer about the matter. When the car was impounded, the police took an inventory, on my request, of what was of value in the car. They told me my stuff would not be touched, and that i had nothing to worry about. My whole car had been ransacked, everything gone through, a perscription with 2 pills left was taken, and all my paintball gear, totaling 2 grand. IS THIS LEGAL? CAN THEY TAKE MY STUFF? i live in Rhode Island if that helps. I went to the police dept. today, they were of no help, statin they spoke to the company and that they are claiming it is legal under the abandoned car law. i spoke to a lawyer, he said they cannot withhold my belongingsa after a verbal agreement to give them back, and if they choose to keep them, they need to detail a list of what they have kept, what its worth and it needs to be taken off the total bill.

Answer:
It was smart of you to have the police take inventory of your belongings - you can now press theft charges against the tow truck company. They had no right to do what they did, and hopefully they'll lose the contract they have with the city for impounds on top of it all. This will cost them A LOT of money - what a bunch of idiots they are.
