Can I take my car back within 30 days of purchase?
Question:
My name is Adam and I'm from Lenoir, NC. About 3 weeks ago, I purchased a used car from a dealer in my city. I placed $1000 down so I could finance it on the lot. As of two days ago, I have been experiencing problems in the transmission. In addition to that, my oil pressure light flashes on occasion, and my antifreeze light does too. Some people say that I have a right to return it according to "lemon laws". I have no idea what the lemon laws are in North Carolina because I'm sure they vary from state to state. I have $1,800 left on the car. What can I do? Is there a law that allows me to return a vehicle within 30 days of purchase, or will I have to fight for this? (When No Manufacturer's Warranty Exists) "If you do not have a manufacturer's warranty of any kind you may be entitled to compensation for violations of consumer protection laws that fall outside of the lemon laws. The following is a list of some of the problems and/or issues which may be present in your vehicle. Prior history of mechanical problems known to the seller: Laundered Lemon. Previously salvaged or wrecked. Fraudulently rolled back odometer. Rental car, police car, taxi, or similar. Stolen, stripped and rebuilt. Involved in a flood. Lemon Laws vary from state to state, so accurate information on the scope and restrictions of Lemon Laws in a particular state should be obtained from an attorney practicing in that state." I have brought the car back to the dealership and they have their mechanics looking at it. I'm not sure if I trust them though.

Answer:
Unfortunately, unless they expressly mentioned a return policy when you purchased the car, you do not have one. That being said, you should still contact them and explain the problems you are having. Have a mechanic from a different shop look at it to get an estimate and to determine if the condition would have been present when you bought the car. The dealership should fix the car for you. If not, find an attorney who will give a free consultation.
