How to get security footage to prove fault?
Question:
Backed up in a Wal Mart into the center aisle. I fully stopped, then noticed a lady pulling out on my left side, I honked twice at her but she kept coming and hit the side of my car. She then filed a claim against my insurance saying we were both backing up and I was 50% at fault. Insurance company will not fight it because we both have the same company, and they assigned 50/50 blame without getting the security footage. WalMart security guy says he watched the video and it clearly shows we were in the center aisle and stopped before she hit us. She was in a Dodge Nitro and I was in a Grand Prix, so she had poor visibility and wasn't using her mirrors apparently. 21st Century insurance doesn't seem to care. They assigned 50% blame saying there wasn't evidence one way or the other, but the security tape exists and they won't do anything to get it, even after we told them about it. WalMart won't give it up with out a police officer getting it, and even though the damage is about $1000 to my car, the Raytown, Missouri cops say "its not worth their time" to pick up the video. What can I do to straighten the insurance agency up and/or get WalMart to provide the video? I would prefer not file a lawsuit, but if that's what it takes, I can get the video in a discovery, but there should be an easier way.... I was stopped and she was backing up at about 1mph, so I don't think there could be any claims for injury, but that's yet another reason I need the tape.
