How do i sue someone in another state who will not honor his part of an Ebay auction of an automobile? Question: I bidded on and won an auction for a 1998 lexus. In the description of the item, it stated that the car was being offered at auction with no reserve. There was also no reserve listed in the price.....
When the auction was over, I received an email from ebay saying that i had won the auction for $9100. I called the company to inquire about payment and shipping. The manager of the CARMAX that was auctioning off the car said he would not sell me the car for less than $15000. He also stated that he would not honor the ebay auction that said I had won the auction for $9200.
Do i have to accept this? Since I am in Mississippi and his company is in Greenville, Nc, would it be appropriate for me to contact my state attorney general's office?
Would a regular lawyer be able to do anyting to help me?
Are ebay auctions considered binding contracts?
Thanks
the $9200 is incorrect. the correct amount is $9100
The company is called Automax...not carmax
Answer:
First off report this to eBay, give them as much detail as possible, including the guys details, and what he has said to you, include any copies of emails sent between you.
They maybe able to help you out, at worst they may stop this guy from listing anything on eBay again. There is a feed back rating, that you can post your thoughts and feelings about a seller. By all means do add some feed back, so this guy can not do the same thing to some else.
My hubby always checks a sellers feed back, to ensure the seller is legit, before buying any thing, and will always add feed back.
I would also speak to a to a lawyer who may also help you out. One who deals pacifically with buying and selling.
I wish you luck in this matter.
