Question:
I just found this such a heartwarming story I had to share. (Link cut up so it will post) http:// edition.cnn. com/2011/US/07/02/ gay.soldier.a ndrew.wilfahrt/index.html ?ohyeah Rosemount, Minnesota (CNN) -- Andrew Wilfahrt changed his gait in the weeks before going off to basic training. He walked more upright. He bulked up with weights. He spoke with a deep Robocop voice. He acted "manly." Through the eyes of his parents, Jeff and Lori, it was all a bit strange. This was the boy who told them he was gay at 16 after being confronted with exorbitant bills from Internet chat rooms. Who lobbied for gay rights in his high school and escaped the fists of football players when hockey players came to his rescue. Who had the courage to wear pink and green even after his car was spray-painted with "Go Home Fag!" All his parents ever wanted was for Andrew to be Andrew. At 29, he sat his mom and dad down at the kitchen table and told them his life was missing camaraderie, brotherhood. "I'm joining the Army," he said. The news surprised them. Why would Andrew enter the military, where he'd be forced to deny a part of who he is? He was a lover of classical music, a composer, a peace activist, a math genius. He studied palindromes, maps, patterns, the U.S. Constitution, quantum physics. A soldier? It had never really crossed the minds of his left-leaning parents. Yet, just as they'd done with all three of their children, they supported him. It wasn't easy. It became dreadfully painful. When their son wound up in Afghanistan in July 2010, Jeff awoke early each day to Google "Kandahar." He tracked every soldier killed in the far-off land. Then, on February 27, 2011, at the same oak table where Andrew said he was joining up, the Wilfahrts learned their oldest child was gone. "I want to talk directly to somebody in his platoon!" Jeff told the officer and chaplain seated across from him. He wanted to know for sure that this wasn't a behind-the-shed killing of the gay guy. Cpl. Andrew Charles Wilfahrt, 31, is believed to be the first gay U.S. soldier to die in battle since President Obama signed the repeal of "don't ask, don't tell," the policy forcing gays in the military to hide that part of their lives or risk being kicked out. He was also among the smartest in the half-million force, scoring a perfect score on his aptitude test, a feat the Army says is rare. Andrew was so well-liked his comrades named a combat outpost for the soldier with the infectious smile. COP Wilfahrt sits 6 kilometers from Kandahar. To his buddies, it is not named for a gay soldier, but for one who fought with valor. I doubt you even read. Wow I hope second answerer is a troll. The fact is people he didn't identify as gay. He did duty for his country. ? understands the point. Pontius: Ah you missed point. He fought for his country and didn't identify as gay and was generally an amazing person. That's why it's heartwarming.

Answer:

Unlawful Search of a car trunk?
Question:
I was recently driving my Subaru WRX, and in my haste while driving I attempted to pass a car that was in front driving to slow on a two way street (1 lane in each going each way) in a 55mph zone. In my haste I ended up having to drive off to the side of the road to avoid getting hit by an oncoming car. In this action I took out a no parking sign with my drives side front bumper. Needless to say Minnesota Rosemount Sheriff Police officer showed up at the seen of my accident. He asked me to describe how the accident took place. Giving him a detailed description of the event (Needless to say I was nervous and greatly upset because of my poor decision). After hearing my story he asked me if I was on crystal meth?! Which I wasn't and have never done it. After asking me if I was on meth the sheriff asked if he could search my car, in which I responded no, due to the fact that I didn't think he had a probable cause too. To which he responded I am going to any way. He searched the cab and main compartments of my car (which was spotless and free of any pot droppings or crumbs that may have been around). After the search of my main interior the sheriff popped the trunk of my car, which was locked and from my understand you need a warrant or probable cause to do so. After the search he recovered jar of gonja filled with around one ounce and scale. Which I said was all for personal use. The actual offense I received on the ticket is as follows: Drug Possess Marijuana in a motor vehicle; Driver or Owner (152-027-3) - State ordinance code. (I am a resident of MN) My main question being, did the sheriff have probable cause or even able to search my trunk without a warrant? Did the accident give him probable cause? Any thoughts???

Answer:
U.S. v. Ross (1982) found that probable cause was sufficient for a police officer to search "containers" within a vehicle, including its trunk. This precedent follows a group of cases ruled on by the Supreme Court (Carroll v. US, Arkansas v. Sanders, etc.) that make up an exception to the search warrant required by the fourth Amendment that is commonly called the "motor vehicle exception." Whether or not he had probable cause can be decided by the courts. The officer will have to have been able to articulate in his report the factors that gave him probable cause to search your vehicle. If you decide to go to trial, your defense attorney can file a pretrial motion to suppress the evidence (the marijuana and scale) on the basis that the officer didn't in fact have probable cause. If he can convince the judge that probable cause was lacking, the evidence will be suppressed and the case will likely be dismissed. Hope that helps.
