How do you fight a parole officer who wants to put a mother in jail who needs chemical dependency treatment?
Question:
This is in Ramsey County Minnesota. The mother has no violent crime history, and is a felon due to the fact that there was crystal meth in her car when they arrested her for shoplifiting some chicken salad from a grocery store. She has horrible ADD, like I have never seen or heard of, truly, she can't recall or focus on ANYTHING. Anyhow, she needs a good long treatment, not to be thrown into a population of other felons, which is totally proven to not help her in any way as far as I have ever read or seen. The parole officer is an angry-seeming bloke who is hell-bent on putting her behind bars. She is an IV drug user as of a few months ago, having moved it up from smoking meth for years past. What is goofy is that he wants her in jail first, then treatment. HELP

Answer:
The Ramsey County courts will likely remand a felon to a Minnesota State Correctional Facility where she can be put in drug treatment while serving time. Another option could be to be sent to an RTC, or Regional Treatment Center which is a locked facility for mental health treatment patients who are court-ordered. The parole officer may want the order of the court to force this person to get the treatment they seem to need, and since that person is an IV drug user now while NOT in custody, putting them into custody may be the best option as the PO sees it.

What will happen 15 years old charged with felony theft?
Question:
I'm 15 n just had the worst experience of my life. I'm a good kid but went to a party n hung out with some people then all of a sudden they were goin for a walk n I tagged along they started scoping cars and seeing for stuff inside 1 kid got 2 gps' and n iPod shuffle bunch of headphones n flashlights( what a retard huh?) the next kid found iPod classic 80 gig while I was watching out I felt like I could get something but I was to scared to grab something so I popped the radio cover off a car and left we go back n apparently the part kicked us out so we had no choice but to walk home but just our luck the po po show up sayin we match the description of some thieves he searches our back pack finds it arrests all three off us n we go to the police hq where their pressing us saying we stole more than we did eventually I got picked up from my mom but the investigator said it is felony theft this happened in ramsey Minnesota I pretty much want to know what I'm looking at I don't want to go to Lino i need to kno if I go how long or if I'll do community service or probation

Answer:
Okay lets Look at the facts your 15, never been trouble with the Law before, were talking a charge that is by most standards will be dropped down to a misdemeanor so I would contact a decent Lawyer explain what happened and just do what he suggest. Know one thing your young try and be very careful because though a felony charge can be reduced you need to be careful you do not want to mess up you future, watch who you hang with and stay away from people that do not care about where they are going in life, believe me I was 16 and committed some serious shit and was convicted and went to prison for 5 years at 16 years old do-not I REPEAT do not run that course you will certainly LOSE!!!!!

Why was this car towed?
Question:
So, I have just awoken to the sound of a Tow truck outside my apartment window. Naturally I got out of bed to make sure it wasn't mine. Turns out there was a squad car outside with a tow truck. The truck was towing the car away, with no owner in site. My question is, what possible reasons could the police have to come in the early hours of the day and tow a car away without any warning to the driver? (I am in ramsey county, Minnesota) (if it wasn't for the squad car i would swear they were stealing the vehicle) The car was in a Parking Lot

Answer:
Probably a serious traffic violation, could have been identified as a stolen car, etc. When a car gets towed away, the driver is seldom notified until the car is actually impounded. However, I must admit that where I live the presence of a squad car is no assurance that the car is not being stolen.

How do I file a complaint against my neighbor?
Question:
I live in Ramsey County in Minnesota. The street that I live on has free, public parking and the garages are in the back (no driveways). My neighbor John hates when people park in front of his house. There is a church at the end of the block and every night and especially on Sundays it is really busy on our street with virtually no where to park. One time I parked in front of his house because there was no where else and he pulled in and inched up to about three inches away from my car, got out of his truck and stood and stared at my car then walked over to my house and yelled at me to move my car. Literally yelled so that my hard of hearing mother heard him from upstairs. Just last weekend some church people had parked in front of his house and he came home, backed up to their car, stopped, and then rammed into it. I informed the owners of the car but they decided not to do anything because he only dented their license plate. I am wondering where I go and who I talk to in order to file a complaint against him so I can hopefully put a stop to him and his ridiculousness.

Answer:
Don't personally get involved with him. Go to the police. He doesn't decide who can and where someone parks. If he runs into or physically damages anothers property, yes that is breaking the law. Plus you also have harassment every time he comes to your door and yells at you. I'm believing it's happened more than once. Call the police. This can be handled by them. Very simple. Good luck.

marijuana in a motor vehicle, first offense?
Question:
Ok, so I was with three of my friends and we were going to the park. I park (legally) and before I even get the chance to get out of my car the cops are already around the corner and pull us over. They told me they had a report about someone smoking marijuana out there a little earlier. When I asked what color car was reported they said "white", but my car is black so I don't know what gave them cause to pull me over. I was ticketed for Marijuana in a Motor Vehicle. I was not ticketed with anything else. I was not detained. Also, I was NOT aware that the Marijuana was in my car! I live at a fraternity house and I keep my keys in a mailbox which is unlocked so anyone could get in my car and I let my friends use my car (two of which I know for a fact smoke marijuana). My friend in the passenger seat had marijuana as well. He had taken out his grinder just as we got pulled over and he left the damn thing in the cup holder for the cops to see. Again, I was NOT aware that he had marijuana in my car. He just took it out and I told him to put it away, but as soon as I told him to do that the cops were already there. The marijuana which they took did belong to me, but I did not put it in the car. I had given it to a friend to hold onto and either they or someone else put it in my car. The cops found it under my seat....I was not even aware it was there. This is my first offense. On January 5th, 2011 my fiance passed away and on February 21, 2011 I myself almost died in a near fatal car wreck. It ruined me and I turned to smoking to mask my depression. I've been entirely clean since the bust and have only smoked since February and not regularly. It was a mistake and I wish it would have never happened, but I lost the one girl I ever loved and I was distraught, emotional....I wanted to die, so I turned to pot. I've never done any other drugs. I don't even drink alcohol (my fraternity is dry). I'm a 4.0 College student. I'm 19 and male. In the state of Minnesota. My court is Ramsey County (which is tougher on drugs than the other adjacent county is). I was valedictorian of my high school. The max penalty for marijuana in a motor vehicle is $1000 and/or 90 days in jail. What do you think my chances are? My record is entirely clean. And the law states "...The owner of the vehicle is guilty if they knowingly allow Marijuana within the vehicle..." Again, I was not aware of it being there.

Answer:
if you plead guilty and call it a stupid college mistake you'll get a couple hundred dollars in fines, probation, and maybe a suspended license. edit: if there was a grinder in plain sight the cop had probable cause to search your car. you SHOULD lawyer up, but he's gonna tell you the same thing. if you try to fight a drug case like this in a county that's notoriously hard on drug offenses, you're gonna get the book. know when to hold 'em, know when to fold 'em...

Should Coleman counter sue Franken for all those questionable bags of votes in a car trunk for Franken?
Question:
ST. PAUL, Minn. – Republican Norm Coleman must pay Democrat Al Franken $94,783 to cover court costs for his appeal of Minnesota Senate election results. A Ramsey County court administrator entered the judgment Wednesday. It results from the two-month trial that ended with Coleman 312 votes short of Franken. Minnesota law required Coleman to cover some of Franken's court costs because the race's outcome didn't change. The judgment excludes Franken's attorney fees. The men have spent $50 million so far on their campaigns and legal fight over the November election. That's more than double the cost of the 2002 race when Coleman captured what had been a Democratic seat. The Minnesota Supreme Court hasn't said when it will rule on Coleman's appeal.

Answer:
I believe this has already been brought to the attention of the court. Coleman should and probably will if he has not begun already to sue Franken for these "questionable" votes. Isn't it odd how the "questionable" ballots are always in the favor of one party (which I will not name)?
