If I put a down payment on a car in Minnesota, and they refuse to give it back to me, what can I do?

I paid a down payment on a car at Crystal Motors in Crystal Minnesota. I ran a vehicle history report on the car and was pretty pissed that they didn't tell me that it had a lemon title. Now, they're giving me an extremely hard time trying to get my down payment back. They told me to call back the next day when I went in because their finance person wasn't there. So I did. Then, they told me it would be mailed out at the end of the month with a $15 finance fee. So I waited...nothing. What should I do now? I didn't sign anything... I PAID WITH A CREDIT CARD AND I HAVE A RECEIPT. DO THEY LEGALLY HAVE TO GIVE IT BACK TO ME?

How do you fight a parole officer who wants to put a mother in jail who needs chemical dependency treatment?

This is in Ramsey County Minnesota. The mother has no violent crime history, and is a felon due to the fact that there was crystal meth in her car when they arrested her for shoplifiting some chicken salad from a grocery store. She has horrible ADD, like I have never seen or heard of, truly, she can't recall or focus on ANYTHING. Anyhow, she needs a good long treatment, not to be thrown into a population of other felons, which is totally proven to not help her in any way as far as I have ever read or seen. The parole officer is an angry-seeming bloke who is hell-bent on putting her behind bars. She is an IV drug user as of a few months ago, having moved it up from smoking meth for years past. What is goofy is that he wants her in jail first, then treatment. HELP

The Ramsey County courts will likely remand a felon to a Minnesota State Correctional Facility where she can be put in drug treatment while serving time. Another option could be to be sent to an RTC, or Regional Treatment Center which is a locked facility for mental health treatment patients who are court-ordered. The parole officer may want the order of the court to force this person to get the treatment they seem to need, and since that person is an IV drug user now while NOT in custody, putting them into custody may be the best option as the PO sees it.

Unlawful Search of a car trunk?

I was recently driving my Subaru WRX, and in my haste while driving I attempted to pass a car that was in front driving to slow on a two way street (1 lane in each going each way) in a 55mph zone. In my haste I ended up having to drive off to the side of the road to avoid getting hit by an oncoming car. In this action I took out a no parking sign with my drives side front bumper. Needless to say Minnesota Rosemount Sheriff Police officer showed up at the seen of my accident. He asked me to describe how the accident took place. Giving him a detailed description of the event (Needless to say I was nervous and greatly upset because of my poor decision). After hearing my story he asked me if I was on crystal meth?! Which I wasn't and have never done it. After asking me if I was on meth the sheriff asked if he could search my car, in which I responded no, due to the fact that I didn't think he had a probable cause too. To which he responded I am going to any way. He searched the cab and main compartments of my car (which was spotless and free of any pot droppings or crumbs that may have been around). After the search of my main interior the sheriff popped the trunk of my car, which was locked and from my understand you need a warrant or probable cause to do so. After the search he recovered jar of gonja filled with around one ounce and scale. Which I said was all for personal use. The actual offense I received on the ticket is as follows: Drug Possess Marijuana in a motor vehicle; Driver or Owner (152-027-3) - State ordinance code. (I am a resident of MN) My main question being, did the sheriff have probable cause or even able to search my trunk without a warrant? Did the accident give him probable cause? Any thoughts???


Answer:
U.S. v. Ross (1982) found that probable cause was sufficient for a police officer to search "containers" within a vehicle, including its trunk. This precedent follows a group of cases ruled on by the Supreme Court (Carroll v. US, Arkansas v. Sanders, etc.) that make up an exception to the search warrant required by the fourth Amendment that is commonly called the "motor vehicle exception." Whether or not he had probable cause can be decided by the courts. The officer will have to have been able to articulate in his report the factors that gave him probable cause to search your vehicle. If you decide to go to trial, your defense attorney can file a pretrial motion to suppress the evidence (the marijuana and scale) on the basis that the officer didn't in fact have probable cause. If he can convince the judge that probable cause was lacking, the evidence will be suppressed and the case will likely be dismissed. Hope that helps.
