Do you really have to drive exactly the maximum or the highest speed posted when driving a car on the road?
Question:
If I was driving on a road, and the highest speed posted that I could drive was 40 MPH, would it be okay if I drove 35 MPH on that road, without getting stopped by the police for driving too slow? I live in the state of Michigan. I live in Inkster, Michigan a suburb of Detroit, Michigan.

think about it- what if you were stuck in dead stopped traffic. would you be driving exactly 40 mph?

Any advice on fighting a ticket in court please?

Ok I got a ticket for doing 45 in a 40 (where it says remarks it says 53/40) meaning i was actually doing 53mph in a 40mph If it helps it was in Inkster, Michigan My side of the story it was on a street i never drive on (Michigan avenue) which has a center median like telegraph and the speed limit down telegraph is 45 and just didnt really think of the speed limit at the time. and had just pulled on michigan ave within a mile earlier then got stopped at a light and then realized i had to get over so got up to about 45 and the cars next to me were too close to each other so i couldnt get over so i sped up a lil bit to just get infront of them and before i noticed any speed limit signs i was being pulled over. It was at about 11:30am there was not alot of traffic, no school zone no construction or anything like that. The cop really only said could i get your liscence and regristration, then came back to my car and said you were doing 53 in a 40 but ill give you a ticket for 5 over, handed me the ticket, and suggested i take it to court, and that was all, he did not ask any questions or say anything else and i said nothing other than okay. Im only 21 and the last ticket i got was when i just turned 17 for doing 5 over on the freeway and thats it. any advice would be great on how to explain and what to say and not to say. Pleaze help i have to leave for this in about a hour and a half. Oh yeah and i do have a reciept from home depot which was where i was going, stating the time of 11:45pm just for proof that i was trying to get over to go to home depot on Michigan avenue at the next intersection. Should i bring this?

To fight the ticket the Officer has to be present, if he is telling you to fight it, it sounds like he doesn't really care and just might be trying to make quota and you make get out of it or get it reduced anyways.

I was assaulted and the cops arrested me for DUI, i wasn't even drunk?
Question:
Ok this is a 2 or 3 part question. This happened in Inkster Michigan. Was driving home from a Detroit when my so called buddy (whose car i was driving cause i was wayyyy more sober) said something that made me mad so i started yelling at him. Then as we were driving at 50 mph down Michigan ave he started throwing punches at me. I don't remember how many times he hit me, I remember two punches then the next one knocked out my front tooth and some punches after that i was knocked out while driving the car. I couldn't have been out long maybe a few seconds because the next thing i remember is coming too while driving in the grass. I gained my sense and steer back to the road when i realize all the brakes are out. (I thought brake lines were made not to do that but it happened. had to of hit something while i was out) After that i hit a curb which did a lot more damage to the car and deployed the airbag. Someone who saw the crash called the cops, they came and questioned him but not me. they take me to jail and tell me they are charging me with a DUI and that i reeked like booze and that my buddy told them i stole the car and i deserved what i got. They never breathalyzed me because my mouth was pouring blood. 2 hours later they take me to the hospital and take a blood sample. I know i am good on the DUI because i know i wasn't over the limit at the time of the crash let alone two hours later. The cops release me to the hospital and never hear from them again. This happend two weeks ago and i have not filed a report yet. I did take pictures of my messed up face. question 1. Because i waited so long to file a report will that hurt my case? Question 2. This DUI has no chance right?? Do I need a lawyer for that too? Question 3. I haven't filed a report against him yet because i think its a huge piece of leverage over him. He is on probation for a DUI which he got just after getting off for an MIP. The problem is if no deal is made then what? i have no record of the incident except hospital. Then i cant sue? Im not trying to screw this guy even tho he deserves it but i want and need money for the bills he caused me(6 grand from ER and im still missing a tooth) I Just want to make sure i have the best chance for getting my money. I also know he has been taking vicoden illegally can i use that against him? The test will not show an illegal amount of alcohol but not sure if any will show up on test at all.

1. Maybe, hard to say 2. Well, I'd want to have an attorney even so. If you had zero Blood Alcohol level I'd be feeling OK I guess but paperwork mixups, etc. Did they cite you? Have you had a court date? If the blood comes back with any alcohol and your all over the road in an out of control accident, they might just go for that DUI. Did you do a field sobriety test or anything other than BAC? 3. If they investigated an accident and arrested you and transported you I would expect they already did one.. And they didn't believe your buddy or they would have arrested you for car theft. But then he was in the car so how does he claim you stole it? Go ask the police for a copy of their report. I think your buddy should be kissing your feet about now and you shouldn't need to file a suit against him, but you should definitely make sure there's a document trail. Especially useful is photos and it's too late to do that.
