Using insurance check on stuff other then my car?
Question:
Here's the deal, I got into an accident a month ago on Route 1 in Saugus, Massachusetts. It was a really rainy night and I was on the right hand lane of the highway about to get off on the exit coming up, and some guy pulls out of a shop on my right going 2 mph and I have to swerve to the other side of the highway to avoid him. In doing so, I hit another car. In the end, the guy who made me swerve got away and me and the guy I hit pulled into a shop near the accident. Now, I don't know who's fault it is legally, but I know that I was doing nothing wrong, I was just trying to not die. Either way, the only damage to me is on my drivers side rear. I filed the claim, and they sent me a check for the damages after my $500 deductible. Now, the damage doesn't bother me at all. The car is completely paid off. I never plan on selling this car. I live in Massachusetts. I really can't afford to put up $600 of my own money for a situation where I was doing nothing wrong. Do I have to use the check to fix the car? Or can I just pay off some credit card debit like I want to. Also, are their any consequences I'm not considering?

Answer:
You can keep the check and do whatever you want with it. The insurance company does not care and it is legal. They are paid what they were suppose to pay and that is the end of it for them. By the way, the accident was still your fault because you lost control of the car. You did nothing wrong. It is a natural reaction to avoid hitting someone else. This is a catch 22 situation. If you would have hit the guy that cut you off the accident would have been his fault. But it is a natural reaction to avoid hitting someone. But since you swirved and lost control of the car and hit someone else the accident is your fault. It may count of your DMV record. Check with your insurance agent. Every state is different. But don't worry about the money. It is yours to keep and do whatever you want with it.
