My husband just got arrested in Madison County Indiana for operating a motor vehicle while intoxicated. His friend was arrested for public intoxication. They were driving on I-69 and ran out of gas. They got out of the car to walk to a gas station to get gas, but before they got very far a cop car came up behind the car so they walked back. I understand that they can get in trouble for being intoxicated but can my husband be charged with an OWI if he was not in the car when the officer got there. Obviously he was driving because the car was on the highway, but if the officer didn't pull him over while driving shouldn't he only be charged with public intox?
