Ok, This is really long But I have to tell the story. Last September..In elkhart County Indiana, My Boyfriend was involved in a dispute with an EX. Me, him, Our friend and his Ex's Brother were hanging out. Playing video games and doing nothing wrong at all. It was a Friday at 10pm. When there was a knock at our apartment door. My BF looked thu the peep hole and couldnt see who it was. He opend the door 3-5 inches and the person(s) on the other side pushed their way in. It was his ex's mom and his ex. She came in OUR apartmenrt Unlawfully. She said that her son was here and that he should be there. the son already was out the door in the hallway. she preceded to sit on the arm of our couch to dial the police. My BF walked her out, not in a aggressive mannor, but To get her out. She then tripped over the metal doorstop under our door. She fell and scratched her arm. Kinda like a Cat scratch, thats wat it looks like. His ex thought that he pushed her mom,(he didnt though) came up, punched him in the face, slapped him, and then scratched his shoulder neck area. He never got his copy of the report or anything. He had his hearing and plead not guilty. He had an Onubus heraring with the proscecutor, and now in a month or so he has to go to Trial. He would be entitled to obtain a copy of the report. He can make a written request to the police department and the prosecutor's office that asks for all records and reports pertaining to that night. He didn't have a hearing. He had a first appearance. You need to look up the laws specific to Elkhart to find out what exactly they are referring to. The only thing that comes to mind is that the brother must be a minor. If that's the case, then it's possible there is some statute that would allow a parent to retrieve their child - but I don't know of any jurisdiction that would allow a parent to resort to self help under these conditions. But the whole thing could have been completely avoided if your bf hadn't opened his home to a juvenile . . . especially when he knew there was bad blood. If what you say is completely accurate, then it seems likely that your bf would be permitted to use REASONABLE force to eject a trespasser from his home. (Under absolutely no stretch of the imagination could deadly force be used against a trespasser.) Was there alcohol involved? I'm trying to understand why your bf was the one arrested and I have this sense that there is more to this story. Your bf should have had plenty of witnesses (you and the brother) to support his account of what had happened. The mother and the ex shouldn't have been as credible considering they came to his home. If he's not eligible for a public defender, then he's not eligible. There's nothing he can do. As far as finding a lawyer for a reasonable price? That's a bit of a contradiction of terms. Lawyers tend to be expensive. Depending on your area, your bf will probably need a retainer (initial fee) of between $750 and $1,000. But the first thing he should do is obtain a copy of the police report so he can read exactly what the police learned that night. She needs to have enough beds for them all. Girls and boys need to be in separate rooms. She needs to make sure fridge and cupboards have food. I would suggest if possible turning half of the basement into an area for the kids. Be it a bedroom, study area, or play area. I suggest getting bunk beds or loft beds(can make a study are or put dressers under the loft beds). Freecycle and Craigslist are good places to start. I am not sure how much they will look. But CPS will get involved because she needs guardianship to care for them. She also will need to apply for the benefits her kids will get from losing parents. That will help a little bit with bills. She is a wonderful women for doing this. Local Churches might help also.

He said that if you're stopped at a red light late at night and the censor to it doesn't register to change the light green within a certain amount of time that it's legal to turn on your hazards and go through. I won't do it even if it is ok but I'm just curious because unless you back up and go forward, switch lanes or a car comes from the opposite direction there are quite a few lights in Elkhart that take FOREVER to change.
