I got 4 traffic citations in Georgia that I want to fight, what should I do?
Question:
Last week I was pulled over on my way home from work in Riverdale by an officer. The cop hit me with 4 citations: one for aggressive driving, one for speeding (60mph in a 45), one for failure to signal, and one for failure to maintain lane. Basically what happened was I was on a 3 lane street where the far right lane was ending. I jumped in the far right lane to pass slower traffic in front of me then merged over into the center lane without signaling (didn't think it was necessary to signal when merging). Right as I merged into this lane, two cars in the far left lane slightly ahead of me changed over into the center lane, giving me one of two options: either slam on the brakes and slow down or move over to the left lane and pass them. I unwisely chose the latter option, and since I had a very short time to react I didn't have time to properly signal this second lane change. There was a cop stationed at the top of a hill that saw all of this and as I drove past he immediately jumped in his car and pulled me over. I can't afford the fines (according to the court website, it will be $145 each for all except the aggressive driving citation), the points on my record, or a lawyer. I also was just recently hired as a lowly lube technician at a Ford dealership, and this many points on my record and the subsequent increase in cost in the dealership's insurance may actually jeopardize my job, so I plan to fight the charges myself. The aggressive driving charge carries a mandatory court appearance, which is currently set for May 14, while I have the option of just paying the fine for the other three. I am planning on filing for a continuance tomorrow and then fighting at least the aggressive charge. I'm a bit confused on if my mandatory court appearance is intended solely for me to enter my plea (and pay the fines if I enter a guilty plea) or if my trial will take place right then and there if I enter a not guilty plea. Also, if the cop fails to appear, will all the charges get thrown out or will the aggressive driving charge be the only one dismissed with all the others still left to be settled? I've already done some preliminary research and I've seen different websites mention filing a motion for discovery to get access to the officer's training records and calibration records for the radar gun. Is this necessary to do before I go to trial if I plan to request that information as evidence during the trial? Also, about how much can I expect to pay in court costs? Lastly, while I already have a pretty good idea of how I want to fight the speeding charge, I have no clue how to fight the other traffic charges. Any advice there would be appreciated. I know this is a loaded question, but if anyone can answer at least some of these questions it would really help. Thanks.
