what local agency is available for helping disabled find help? Port Charlotte, FL?
Question:
Looking for group/agency that provides assistance to the disabled as to what is available to them, such as installing wheel chair ramp, getting lift for car to transport elec. wheelchair, etc. Looking for an agency in Port Charlotte, FL area.

Answer:
Hi Lois, we may be in the same boat. Assistance around here can be somewhat difficult to obtain. It's not for a lack of caring (though sometimes it feels that way) it's sometimes a lack of resources. Start with the following link to the county 211 site: http://charlottecountyfl.com/HumanServices/211.asp If you cannot find what you need there, then, everyone who has been through this will tell you to check with our local religious congregations. For the vehicle, there is only one place I know that does that sort of work; Access Able Mobility Products ( I have no experience with them though I have heard they do good work) Also, take a look at this link that may provide more info: http://maps.google.com/maps/place?hl=en&client=opera&hs= Ay6&rls=en&um=1&ie=UTF-8&q=%22Port+Charlotte%22+disabled&fb=1&gl= us&hq=disabled&hnear=Port+Charlotte,+FL&cid=915758953082544604 Best Wishes to you. I was charged with Failure to Yield,?
Question:
I left a median after viewing that it was clear, The next second a car came from much behind me and began passing me on the right, I was forced to stab the brake to avoid hitting that car, the next second I hit the gas (it was now in the middle of a state road) but it was too late. The impact was on the strip between the passenger front and rear doors. The car's driver that hit me and all of three witnesses said the same thing "that I would have made it if it had not been for that car that passed me illegally." Do I have a defense? Port Charlotte, Florida

Answer:
Yes and No..... Talk to your insurance company and get your witnesses to sign an affidavit stating what they saw and have them notarized, you have a good chance.....

arrested in error - lawsuit?
Question:
My son was arrested on a warrant issued in error. He was assigned 62 hours community service for driving a car without a current registration. He worked 63 hours and turned in the document on time and correctly. A few weeks later police showed up at my house with a warrant for his arrest; the warrant stated he was in violation of "Parole". He was arrested and I bailed him out. We called the attorney and he called the DA, who admitted it was a mistake and is returning the bail and closing the case. He was arrested due to negligence of the Court or DA. He was arrested in Sarasota on a warrant issued due to a math error by the Clerk of Courts in Port Charlotte. He was not on parole, he was given community service for driving a car that was not registered. When ticketed, he did not have a job (he is in college), so the judge gave him 62 hours of community service. He did the community service and was then arrested in error because the Clerk made an error of addition and thought he owed another 7 hours. I bailed him out that night, and since then the DA has refunded the bail. I assumed he would have a case not against the arresting officers but the Court since he was incarcerated due to negligence. Certainly his reputation has been harmed as a picture of him was posted online stating he was arrested for Parole Violation; as an ROTC cadet and future Naval Officer that causes harm. Even though it was in error it was posted online and once on the net it never dies. Does he have a case? Thanks for all answers - this question is aimed at someone who has experience with the law rather than an opinion question. Legally, does he have a case? Not a question on moral hazard, just law. The only damages are to reputation. As a future Naval Officer he takes reputation seriously, but more importantly, the Clerk needs to be corrected. What if he didn't have a father who could help? good answers on the board here. thank you 'laughter', 'jury' and 'howard' for being frank and direct

Answer:
Yes he has a case but my guess is it's not worth pursuing because it will end up costing more than he could collect. Your problem is he hasn't suffered any real damages yet other than some possible embarrassment. The records have been corrected so it's unlikely anything further will happen. Florida has a 2 year statute of limitations on cases of slander or defamation of character so if anything happens because of this in the next two years he might consider filing suit then. Edit: He doesn't need to prove negligence, he only needs to prove that he was injured in some way. If there was no negligence he won't collect punitive damages but he will recover what the error cost him.

Should I buy this 1992 Ford Crown Victoria Convertible from Craigslist? ?
Question:
http://raleigh.craigslist.org/cto/953878032.html Quote Email sent to me from seller about car: OK, here is the best I can do: The Car is Automatic (All Crown Vic's are - Or at least come from the factory that way. If I wasn't selling it I would put a 5 speed in) The Car was my primary transportation for about 4 years, I drove back and forth from Greenville (about a 200 mile round trip) once or twice a week and it never let me down or left me stranded. I bought it from a guy in Charlotte because I just had to have a 'Cop Car', drove it back to Greenville, and noticed the car had no Oil pressure. LESSON ONE: Cop cars are surplused out becuase they are worn out. I swapped another police motor into the car, which lasted the next 4 years. LESSON TWO: Crown Vic's were designed to be fleet cars and are very easy to work on, if you have the right tools you can swap an engine out in an afternoon. Apparently I never learned lesson one or I woudn't have swaped in another police motor becuase after 4 years it blew a head gasket. I bought a $400 beat to crap Toyota pickup to go pick the third motor up with (which is the motor in the car now, a 2002 out of a Civlian Mercury Marque with 61K on it) and about that time the Gas started to get expensive and the Toyota got around 35 MPG so I basicly parked the Vic and drove the Toyota from there on. When I swaped the motor in I also replaced the radiator with a Heavy duty replacement (correct for the police package). The Current motor (the 2002 motor with 61K on it) runs great, better than either of the police motors that were in the car. I wouldn't hesatate to get in and take it on a 500 mile trip. Here is the bad news; The transmission shakes. The transmission has shaken since day one, I remember it shaking when I test drove it in Charlotte, I remember it shaking all the way back to Greenville. I attribute this to LESSON ONE (see above) although a transmission shop may be able to flush the fluid or adjust something to clear it up. I don't think it is on it's last leg because I drove it for 4 years with the same shake in it and it never got worse (although it never cleared up either). If you are a gear head you may already know the 92 Crown Vic came with an AOD-E transmission with Computer Controlled lock-up (AOD-E stands for Automatic OverDrive - Electronic). They only used this transmission for one year and then switched to a totally computer controlled transmission so you can't swap a later model Crown Vic transmission in it because the '92 computer won't control it. You might be able to swap an earlier transmission that requires no computer control (like a C4 or a C6) into it; or perhaps a 5 speed out of a mustang if you are really handy with fabrication. Or you can just leave it be like I did. Also the 2002 is the PI (Performance Improved) motor which has the factory ported heads and bigger cams in them, I think it is good for about 35 HP over the 92 spec engine. I love Crown Vics, they are the last American Rear Wheel Drive car that came with a V8 on a full frame. They are fast but don't feel like it cause of the suspension, they drink gas (I think this got 16 MPG no matter what) and you can hide 6 or 7 bodies in the trunk. There is nothing quite like it. I wacked the top off last summer so I could have a convertible and figured I would send it to the scrap yard after I had my fun with it. I just don't have the heart to do it. On a legal note, I got the car inspected the day before I cut the top off (june I think so it is good through june of '09). I don't know if it will pass inspection or not; there is no specific way to fail a car because of 'body work' but who knows? I usually go out in the country (like out to rural Knightdale or Wendell) to get 'questonable' cars inspected. Anyways, I have run way off track Yes, the car drives as is; nothing needs to be fixed on it. Shoot me an E-mail or give me a call; I take care of my father part time and don't have a conventional 9-5 job so I am pretty flexible as far as setting up a time to meet. Let me know what is good for you and I will make myself available

Answer:
Not for a daily driver at least. If you were looking for a project car, maybe. I think it looks dumb with that paint. Also, indoor latex is not a good idea on a car. The whole thing looks like a hodge podge amateur job. If for some reason you do buy it, expect for things to go wrong and costly repairs. It does not appear to be in good shape and some of the description is suspect. The fact that it probably won't pass inspection is also troubling. It has had a history of trouble and will have more soon. I advise you don't bother.
