Is the manager and/or owner of a building in Florida liable?

My question pertains to the building that exploded in Deerfield Beach, Florida this past Thursday morning. My car was totalled by falling cinder blocks from that building. The cause of the explosion seems to have been the propane system that was used for the water heaters, stoves and laundry rooms. That same building was cited with 14 violations by the city fire marshall last year. It is not known as yet if any of those violations relate to the propane system. Additionally, the city fire marshall was several months late inspecting the building. Is the building manager and/or owner liable to pay for the damages? If so, what damages can be recovered? Does the status of whether or not the propane system was cited in the prior year have a bearing on the issue? On September 24, 2007, the Florida State Fire Marshal's office released a report stating that "an explosion last Thursday at a Deerfield Beach apartment complex was an accidental fire that started in a propane gas line leading to a stove in a vacant apartment." Does this establish liability on the part of the owner or manager or not?


Answer:
I disagree with both answers. There is no proof of liability at the moment and until the final results of the fire marshall's investigation concludes. You may sue anyone involved, including the owner, manager and the installer of the propane system, but until the investigation is concluded the only option you have realistically is to file a claim with your insurance (if you have full coverage) or wait until such time as fault is established.

Character 1 Eternity Jewel Peace Personality traits: Snobbish and mean-spirited. Selfish, self-centered, and promotes prostitution, drug-dealing, and drunk-driving. Is promiscuous herself and breaks guys hearts all the time. Never apologizes, and never holds herself responsible for her behavior. Genetics: Long curly blond hair that cascades down to her lower back, light gray eyes, and dark brown skin. 5"8. Extremely skinny. Eternity is a 16-year-old African-American with one brother and two sisters. Birth/Place: April 31, 1993 in Egypt, Africa Eternity's background info: Her parents died when she and her siblings were four years old. They grew up in foster care, raised by parents who treated them horribly and set bad examples. Might be the cause of Eternity's own rotten behavior. Eternity grew to be irresponsible, immature, and selfish because of the way the foster parents behaved. Eternity's siblings however are her exact opposite. Siblings: Samantha, Aaliyah, and Abasi Deceased parents: Caro and Amina Peace Ever since being released from foster care, Eternity and her siblings have resided to a house in Deerfield Beach, South Florida, USA, where Eternity's bad behavior skyrocketed. Birth/Place: May 6, 1978 in London, England Her background info: Generous' parents also died when she was very young but due to a horrific car crash. She grew up with foster parents that raised their foster children to be respectful, helpful, and pray to God everyday. Generous is a extreme Christian who offers food, drinks, and presents to her Lord everyday. She is a worrisome woman who is concerned about Eternity. Generous resides in Deerfield Beach, South Florida with her husband and two daughters. She communes between Jupiter, where she works, and her home. Character One: 1) What's with the name? I mean, names are supposed to be unique. But that one is just a little too unique for my tastes. Especially the "Peace" part. I've never heard anyone with the last name "Peace" It sounds like something out of a fiction novel. *cough cough* 2) Oh dear. Eternity sounds, well, entirely unlikeable. Can't she have at least ONE good trait? She also needs weaknesses and perhaps a quirk, to make her more human. 3) Why is she out of foster care when she's only sixteen? The only way I could see this happening is if a sibling took guardianship over her. Is this what happened? 4) I had to resist groaning when I read the background info. The whole evil foster parent thing is just so cliche! Character Two: 1) Again, what the heck is going on with these names? Rational people do not name their children "Generous Loving". 2) Her character sounds much better than "Eternity's", but maybe a little too perfect, and well, generous and loving. 3) I like the Christian theme, but just make sure to make her human and not perfect. So overall, your friend has interesting characters. They need work, though. I hope my comments helped, and tell your friend good luck with her writing!

road trip from florida to mass. question?

I live in a city called Deerfield Beach in South Florida and im supposed to get my license in a couple days. I'm a pretty good driver, i've taken my dads car out plenty of times and i've been told that i'm a good driver. But to make a long story short, I want to drive to Boston Mass in mid October to see a band that i really love, their last show because theyre breaking up. I think i can convince my parents i'm going to my friends in tampa(north florida) but go to Boston and come straight back, it takes 22 hours average 1 way, so 4 days there and back so i guess i would have to take off 5 days. Do you think it's possible to do it without a car breaking down or my parents finding out?

OMG! Driving your Dad's car around town does not a long distance driver make. Continuous driving is tiresome and may put you to sleep behind the wheel if you push yourself or don't get the proper rest. Why lie to your parents about the trip by saying you're going to FLA. when you know you're going to Boston? I know why, because they'll tell you no. Think about the danger in this trip for you,your friend and other people on the road. You're inexperieced, your parents will notice the miles that you'll put on the car and the expenses (gas,food,etc.) The same year I got my license (at 17), I helped my Dad drive our family on a trip which took 16 hours. I was excited and well rested. I drove for 8 hours straight until my Dad made me pull over because he saw the warning signs of being an unexperienced long distance driver, even though I felt fine and I wasn't falling asleep or crossing the lines. I am now 51 years old and a 22 hour road trip is even long for me, and I have been driving for 34 years. You may have to skip this trip.

A mercury Grand Marquis got rear ended on the road yesterday. As soon it was rear-ended, the mercury burst into flames and huge fire ball exploded due to the rear-ending.
