Question: I have a civil dispute going on that a has my friends minivan backing out of our street and theirs 2 cars directly lateral of each other and he accidentally hit the car backing out of the street and scratched her paint on the side skirt. The with of the street is barley accessible by a fire truck and would he be at fault for backing up and scratching her car? or would it be the neighbors problem because she has two cars parked very close to each other, that a Toyota seina can barley make its way out of our street? Answer: The person backing out is responsible. If the cars were legally parked, then there is really no excuse. The law does state that a person driving needs to maintain control of their vehicle. It is a bad idea to park behind a driveway or road, but not illegal unless posted. |
